For more than three decades The South Carolina Law of Torts has been the standard torts reference for the South Carolina Bar. This version of the book represents a group effort involving the two principal authors and the three editors. It is fully updated since release of the Fourth Edition in 2011, is comprehensive in scope, meticulously researched, thoroughly cross referenced, heavily annotated, and logically organized. This edition also includes a stand-alone index and table of authorities. Purchase of the hard copy includes a PDF download of the book text.

As with the Fourth Edition, this edition begins with a brief introduction on the nature of tort law, the underlying policies tort law serves, and the role of process in resolving tort cases (Chapter 1). The next two chapters are organized by the standard of care involved, ranging from negligence to recklessness to strict liability (Chapters 2 and 3). Chapters on product liability (Chapter 4), economic interests (Chapter 5), intentional torts (Chapter 6), and intangible interests such as reputation or privacy (Chapter 7) are addressed in separate chapters due to their unique issues and concerns. Finally, three issues common to all areas of tort law are addressed: damages (Chapters 8); wrongful death and survival actions (Chapter 9); and allocation of liability (Chapter 10). 


This book is designed to assist the bench and Bar by presenting the rules of tort law applicable in South Carolina. Research for the text closed with cases and other authorities as of March 31, 2022. Occasionally, later authorities are noted when a case has been reversed or overruled.
