DRAM Shop Litigation

November 12, 2021

As with any area of practice, success belongs to those who best understand the substantive law, nuances, complexities, science and processes of the particular practice.  Dram shop litigation is no different.  The SC Bar CLE Division is proud to present a balanced and intensely practical program designed to provide both plaintiff and defense counsel with the vital information you will need to successfully prosecute or defend the dram shop or C-Store case.

We are also pleased to offer a unique hour of ethics delivered by Jeremy Babener and Charles Ledoyen. This presentation will help you understand that decisions made before settlement of a personal injury claim can impact plaintiffs' taxes, financial stability, and eligibility for government benefits. Trial lawyers face an evolving duty of care to address these issues unless they compliantly "limit" the scope of their engagement. To do so, you need "informed consent" from the client. This presentation will cover the relevant rules and discuss how to limit the scope of your engagements. It will also help you identify when clients can increase the value of their expected recoveries without demanding more money from defendants.

For most personal injury lawyers, advising on tax, finance, and government benefits is outside your intended “scope of representation.” Remember to obtain “informed consent” from clients to exclude those subjects. To do so, it’s important to disclose potential risks on those issues.

SC lawyers now have access to template documents to do so. The Trial Lawyer Protection Packet has been endorsed by leadership from the AAJ and ethics lawyers from the ABA’s Committee on Ethics & Professional Responsibility.

You can purchase the Protection Packet at a 20% discount by using code SC100. Eligible firms who use the Packet may also receive a discount of up to 10% on malpractice insurance through Swiss Re Corporate Solutions.

This seminar is an intermediate to advanced level program.

* South Carolina Dram Shop Litigation: A Practice Guide by David B. Yarborough, Jr., David L. Savage, and David B. Lail, principal authors, contains a concise discussion of dram shop law in South Carolina followed by a comprehensive guide to litigating these one-of-a-kind cases. With practical application as the guiding theme of the book, this valuable resource discusses the intricacies of all major components of a dram shop lawsuit as well as the strategies for handling the common, and not so common, issues along the way. This book examines dram shop litigation from both counsel tables and provides technical insight from authors that practice in this niche area on a regular basis. In addition, this book delivers analysis from experts in alcohol beverage industry standards and training practices as well as the toxicology of ethanol. Finally, this book contains a host of sample pleadings and discovery materials making it a must-have for any lawyer interested in this specific area of tort law in South Carolina.
